General Terms and Conditions for Guests

1. General
Homes of Croatia is a rental specialist offering a unique collection of luxury holiday homes in Croatia. By making a booking with Homes of Croatia, you enter into a travel agreement. The travel agreement consists of the booking confirmation and these General Terms and Conditions. The travel agreement governs the arrangements between you (the guest) and Austria Promotions BV, trading under the name Homes of Croatia (hereinafter referred to as “we”, “us”, or “HOC”), for the rental of accommodation.
2. The booking
Homes of Croatia acts as an intermediary between you and the property owners of the accommodations. By placing a booking, you declare that you have read and accepted these General Terms and Conditions. The accommodations can be booked directly through our website. After booking, you will receive a booking confirmation by e-mail. The booking becomes final once the deposit has been received. Together with these General Terms and Conditions, the booking confirmation forms the travel agreement.
3. Online offer
The online information about our accommodations has been compiled with care. It is possible that descriptions or photos may differ slightly from the current situation. For example, the pool may be closed in winter or part of the interior may have been renewed. Only if there are major changes can you hold us accountable for this. If we have clearly made an error on our website, such as an incorrect price, we are not bound by it.
4. Payment
The rental price is stated in euros. If you pay in another currency, any exchange rate differences and bank charges are at your expense. If you book more than 30 days before the arrival date, the following payment terms apply:
- Deposit: A deposit of 50% is required. When paying by credit card through our website, this deposit is charged immediately. When paying by bank transfer, the amount must be received by HOC within 3 days.
- Remaining balance: The remaining amount must be paid no later than 30 days before arrival. When paying by credit card through our website, the remaining amount is automatically charged. When paying by bank transfer, you must ensure that the amount is received by HOC on time.
If you book less than 30 days before the arrival date, the following payment terms apply:
- The full amount must be paid immediately. When paying by credit card, the amount is automatically charged. When paying by bank transfer, you must transfer the amount directly to HOC.
The payment date is the date on which the amount is credited to HOC’s bank account. If payment is not received on time, HOC is entitled to terminate the travel agreement. In that case, the cancellation fees in Article 5 apply.
5. Cancellation
You may cancel your booking by sending an e-mail to HOC. The cancellation becomes effective from the moment HOC has received the cancellation e-mail. The following cancellation fees apply:
- Cancellation less than 30 days before the arrival date: 100% of the rental price (no refund).
If you booked the accommodation via an external platform such as Airbnb or Booking.com, the cancellation conditions of that platform apply.
In exceptional cases, HOC may be forced to cancel your final booking, for example due to force majeure or circumstances on the side of the property owner. If this happens, you will be informed as soon as possible and will receive a refund of the amount already paid within 14 days. You will not be entitled to any further compensation.
6. Changes
HOC may make minor changes to the travel agreement and will inform you in time. In case of significant changes that materially affect your stay, HOC will offer you the choice between accepting the change or cancelling free of charge. If you wish to change the travel agreement yourself after a confirmed booking — for example by changing the accommodation, arrival date, or number of persons — you must inform us as soon as possible. Cancellation fees may apply.
7. Arrival & departure
After booking, you will receive a booking confirmation from us. In addition, you will receive an e-mail about one week before arrival containing all necessary information regarding arrival and departure. This includes the address of the accommodation, the contact details of the property owner or manager, arrival and departure times, and other practical information. Check-in is generally from 4:00 PM and check-out is no later than 10:00 AM, unless otherwise stated in our correspondence. Late check-out may result in additional charges.
8. Use of the accommodation
The accommodation is intended exclusively for recreational stays by the guests listed in the booking. It is not permitted to occupy the accommodation with more persons than the stated maximum, including children. Children under two years old are not counted, provided their arrival has been notified in advance.
Organizing a party, event, or gathering with additional persons is not permitted. In the event of a violation of the above, we may terminate the travel agreement with immediate effect and no compensation will be due.
HOC, as intermediary, is not responsible for the condition, maintenance, or safety of the accommodation; this responsibility lies with the property owner. If a swimming pool or jacuzzi is present at the accommodation, use is at your own risk. Children are not permitted in the pool area without adult supervision. The responsibility for supervising children always lies with the adult guests.
It is possible that the swimming pool and/or jacuzzi is not available and/or heated throughout the year. The opening period of the swimming pool and/or jacuzzi is stated in the accommodation description on the website and in our correspondence.
9. Youth groups
If you are under 21 years old, you may only make a booking with HOC’s permission. When making a reservation, you must immediately inform us of the exact number of guests and their ages. If the above conditions are not met, we may cancel or refuse access to the accommodation and no refund of the paid accommodation price will be due. Some accommodations have a different minimum age requirement, which is always clearly stated on our website for the specific accommodation.
10. House rules
The following house rules apply in the accommodations:
- Follow the instructions of the property owner or manager and treat the accommodation with respect.
- Noise nuisance and disturbance must be avoided at all times.
- At check-out, the accommodation must be left broom clean. Dishes must be washed, and waste must be disposed of in the designated area.
Some accommodations have additional house rules. These are visible for the specific accommodation on our website, in our correspondence, or in the accommodation itself. In the event of a violation of the house rules, HOC is entitled to terminate the travel agreement with immediate effect and you must leave the accommodation within two hours. In that case, you are not entitled to compensation. Any cleaning or repair costs may be charged to you.
11. Pets
Pets are only allowed if this is expressly stated in the accommodation description. You are obliged to declare any pet when making the booking. If pets are brought without permission, we may refuse access to the accommodation or terminate the travel agreement.
12. Surroundings
Many of our accommodations are located in rural areas where you may encounter mosquitoes, wasps, ants, local dogs, or other environmental factors such as agricultural activity. HOC is not responsible for construction or roadworks near the accommodation.
13. Damage & security deposit
For some accommodations, guests are required to pay a security deposit. This is stated in the accommodation information on our website and in our correspondence. Unless otherwise stated, the security deposit must be paid in cash upon arrival to the property owner or manager.
If you or any of the other guests cause damage to the accommodation, you must report this as soon as possible to both the property owner or manager and HOC. In the event of damage and/or nuisance, part or all of the security deposit may be withheld. If extra cleaning is required because the accommodation is left in an exceptionally poor condition, the security deposit may also be withheld. If there is no damage and/or nuisance, the security deposit will be refunded upon departure by the property owner or manager.
As a guest, you are always responsible for damage caused by you or other guests to the accommodation, regardless of whether a security deposit has been paid. If the damage exceeds the amount of any security deposit, or if no security deposit applies, you are obliged to pay the full amount of the damage to the owner or manager. In case of intentional damage, we may terminate the travel agreement immediately and no compensation will be due.
14. Complaints & defects
If the accommodation does not meet the description or reasonable expectations upon arrival or during your stay, or if there are any technical defects, you must report this as soon as possible, and in any case during your stay, to the property owner or manager so that the issue can be resolved on site.
The owner and/or local property manager is responsible for the proper functioning of the accommodation. If the complaint or defect is not resolved satisfactorily on site, you must contact HOC immediately to reach an appropriate solution. This may include repair of the defect, a comparable alternative accommodation, or a reasonable reduction of the rental price.
HOC is not obliged to provide a solution if this is reasonably impossible, would entail disproportionately high costs, or if the cause of the complaint lies outside our control, such as nuisance caused by construction or roadworks. Complaints must be submitted no later than 3 days after they arise or within 3 days after check-out in order to be eligible for compensation.
15. Liability of HOC
HOC acts solely as an intermediary between the guest and the property owner. HOC’s liability is limited to damage demonstrably resulting from HOC’s own intent or gross negligence. HOC is not liable for:
- Damage resulting from circumstances beyond our control, including force majeure, extreme weather conditions, or failures in local utility or infrastructure services;
- Damage caused by the guest, fellow guests, or third parties;
- Failures by the property owner or manager to fulfil their obligations.
To the extent that HOC is liable, liability is limited to a maximum of three times the rental price, unless there is intent or deliberate recklessness, or unless limitation of liability is not permitted.
16. Unavoidable circumstances
If circumstances arise that are beyond the control of both you and HOC and that have significant consequences for your stay, you have the right to cancel or change the booking free of charge, provided you do so three calendar days before arrival. You are not entitled to any further compensation.
Examples of unavoidable or extraordinary circumstances include war, epidemics, calamities declared by local authorities, natural disasters, terrorist threats, and blocked access roads. Circumstances that could reasonably have been covered by travel or cancellation insurance are not included.
17. Personal data
HOC processes personal data in accordance with the General Data Protection Regulation (GDPR). HOC’s privacy policy explains which data are processed, for what purposes, and how long they are retained.
18. Changes to these terms
HOC may amend these terms. Updated terms will be published on the HOC website. For travel agreements concluded before the amendment, the terms that were valid at the time of booking remain applicable.
19. Applicable law
The travel agreement is governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands. Where mandatory law in the guest’s country or the country where the accommodation is located provides different protection, that mandatory law shall prevail for the relevant provisions, while the remaining provisions of this travel agreement remain unchanged. In the event of differences in translation, the Dutch version of these General Terms and Conditions shall prevail.
